WEBSITE TERMS
Terms for using this website.
These website terms cover browsing and demonstrations. A signed project agreement defines paid work, scope, fees, intellectual property and support.
CLEAR SCOPE / SHARED EXPECTATIONS
1. Acceptance of Terms
These Terms describe the rules for using Fera Solution’s website and the general framework for discussing our services. By using the website, you agree to its applicable use rules. A project inquiry, demonstration or quotation does not by itself create a service engagement.
Paid services require an agreed proposal, statement of work or other written agreement. That agreement controls project-specific obligations and takes precedence over conflicting general website terms, to the extent permitted by law.
2. About Fera Solution
Fera Solution LLC (“Fera Solution,” “we,” “us” or “our”) provides custom software development, website and WordPress development, web applications and automation, cybersecurity services and digital marketing. Our public location is Herndon, Virginia, USA.
Capabilities, deliverables and support arrangements are confirmed for each project. Website examples do not represent standardized production products or imply certifications, third-party endorsements or guaranteed results.
3. Eligibility and Authorized Use
You must have the legal capacity to enter an applicable agreement and authority to act for any business you represent. Use the website and demonstrations lawfully and respect intellectual property, privacy and security rights.
Do not introduce malicious code, misuse forms or public endpoints, attempt unauthorized access, or submit confidential credentials or real sensitive information into demonstrations. Demo records are synthetic and browser changes may be temporary or stored locally; they are not a hosted production business system.
4. Services and Scope of Work
The written scope identifies services, deliverables, platforms, integrations, exclusions and responsibilities. Technology choices depend on business requirements, budget, scalability, security and existing infrastructure.
Services may include custom business software, websites, applications, workflows, APIs and integrations, authorized security work, or agreed marketing activities. Maintenance, hosting management, monitoring hours, incident support and additional revisions are included only when expressly agreed. Scope changes must be agreed in writing, including their effect on cost and schedule.
5. Quotes, Proposals, Pricing, and Payment
A proposal or agreement specifies the price, currency, payment milestones, invoicing arrangements and any quotation validity period. Third-party subscriptions, hosting, advertising spend, licenses and usage-based API charges should be identified separately where applicable.
Payment deadlines, deposits, late-payment remedies, cancellation charges and any refund arrangements must be stated in the agreed project terms. This website does not establish an unconfirmed refund entitlement, payment deadline or standard fee. Do not submit payment-card or financial-account information through ordinary inquiry or demo forms.
6. Client Responsibilities and Required Access
Provide accurate requirements, lawful content, timely feedback and an authorized project contact. Confirm that you have rights to the systems, materials and data you ask us to use and permission for any requested access.
Agree secure access methods and appropriate permissions before work starts. Do not send passwords through website forms or AI chat. Backup ownership, recovery arrangements and any required test environment must be agreed before migration, potentially disruptive changes or security testing.
7. Project Timelines, Deliverables, and Revisions
Schedules depend on the agreed scope, access, client feedback and third-party availability. Estimates are not unconditional delivery guarantees. Material dependencies or scope changes should be discussed and the plan updated by agreement.
The statement of work should define deliverable formats, milestones, acceptance criteria, review periods, included revisions and the process for additional work. Support and post-launch changes are governed by their own agreed scope.
8. Website and Software Ownership, Intellectual Property, and Licensing
The written agreement must distinguish client-provided materials, newly created project deliverables, Fera’s pre-existing or reusable materials, and third-party components. Client-provided materials remain subject to the client’s applicable rights; third-party and open-source components remain subject to their licenses.
Delivery of files or payment alone should not be treated as a substitute for a written assignment or license identifying which rights are transferred and when. Source-code handover, use of reusable components, license scope, transfer conditions and any permitted portfolio use must be expressly addressed.
9. Client Content, Data, and Confidential Information
Clients are responsible for providing lawful content and appropriate authority to process any project data. Data handling, confidentiality, approved recipients and secure delivery methods should be documented in the agreement and any applicable confidentiality or data-processing terms.
Do not place confidential business records, credentials or sensitive security evidence in public demonstrations or ordinary website chat. Agree access controls and handling requirements for such material before sharing it. Disclosure required by law is subject to applicable legal requirements.
10. Third-Party Services, Hosting, APIs, and Integrations
Hosting companies, CMS platforms, payment providers, AI services, business systems, APIs and other third parties may impose their own contracts, licenses, fees and availability limits. Use of an integration does not make Fera the operator of that external service.
The project scope should identify who owns accounts, pays ongoing fees and manages renewals and changes. Provider outages, rate limits, account restrictions or API changes can affect a solution; responsibility for upgrades, alternatives and ongoing support must be agreed. No third-party availability guarantee is created by these Terms.
11. Cybersecurity Testing — Written Authorization and Scope
Penetration testing, vulnerability assessment, web application/API testing, code review and any assessment of cloud or other systems require documented authorization from the party entitled to grant it and an agreed scope before testing begins. Cloud platforms and techniques must be confirmed for the engagement.
The authorization should identify systems and assets, permitted methods, test windows, contacts, evidence handling, prohibited activities and stop conditions. Obtain any necessary third-party permission. Fera will not interpret a public website inquiry or a demo URL as permission to test a real system. Monitoring, incident response, risk analysis and GRC work require their own agreed responsibilities and coverage.
12. Security Findings, Remediation, and Limitations
Security work evaluates the agreed scope using the information and access available during the engagement. Findings can be incomplete or change as systems and threats evolve; a report does not guarantee that every vulnerability has been found or that a system is completely secure.
Reports should describe findings, limitations and agreed recommendations. Remediation, retesting, incident actions, evidence retention and reporting recipients must be included in the scope or separately agreed. Website security demonstrations are simulations and do not perform real scans.
13. Digital Marketing Services and Third-Party Platform Limitations
Marketing scope may cover website/search optimization, content, campaigns, reporting and agreed planning tools. The client and Fera should confirm approval responsibilities, lawful use of content, advertising budgets and measurement goals before launch.
Search rankings, impressions, leads, revenue and advertising approval cannot be guaranteed. Results depend on competition, audience, budget, the offer and platform rules. Advertising, analytics and social platforms may change policies, suspend accounts, limit targeting or incur fees. Synthetic demo metrics are illustrative, not business performance claims.
14. Warranties and Service Limitations
Any express project warranties, support commitments or service levels must be stated in the written agreement. No promise of uninterrupted operation, error-free software, complete cybersecurity or guaranteed marketing results is made by a demonstration or general website description.
Nothing in these Terms excludes a warranty, right or remedy that applicable law does not permit to be excluded.
15. Limitation of Liability
Any agreed limitation of liability must be consistent with the project contract and applicable law. The website does not invent a monetary cap, blanket exclusion or waiver of non-excludable rights.
16. Indemnification
If indemnification is appropriate for an engagement, the written agreement must identify the covered claims, the responsible parties, exclusions and the procedure for notice, defense and settlement. It should address risks actually associated with the work, such as unlawful client-supplied content or agreed intellectual-property responsibilities.
17. Suspension and Termination
Website access may be restricted as reasonably necessary to respond to misuse or protect systems. Suspension or termination of paid services, including notice, cure periods and any consequences of nonpayment, must follow the applicable agreement and law.
The agreement should specify fees for completed work, treatment of deposits or prepaid amounts, deliverable handover, account access, confidentiality and data return or deletion. No unconfirmed cancellation fee, automatic refund rule or right to destroy client data is created here.
18. Privacy and Personal Information
Our Privacy Policy describes website inquiry, chat and other personal-information handling. Only provide information needed to discuss your request; avoid confidential credentials and sensitive customer or financial information.
Project processing of personal information may require additional agreed safeguards, data-processing terms or client instructions. Permission to respond to an inquiry is not automatically consent to every form of marketing communication.
19. Changes to These Terms
Updated website terms will identify their effective date. Changes to an existing signed project agreement require the agreed amendment process and do not automatically take effect simply because the website wording changes.
Additional notice or acceptance will be provided where required by applicable law.
20. Governing Law and Dispute Resolution
Fera’s public Virginia location does not itself determine the governing law, forum or dispute procedure for every customer contract. Those choices must be agreed and remain subject to mandatory applicable protections.
